2021/033 National Office for the Caribbean Netherlands’ Unit for Social Affairs and Employment put manager’s interests before those of another employee

A complainant referred her case to the National Ombudsman because she was not satisfied with the way it had been dealt with by her employer, the Unit for Social Affairs and Employment at the National Office for the Caribbean Netherlands (RCN Unit SZW). She claims that she feels unsafe in her workplace, where she is subject to harassment and intimidation by her line manager. After she had filed a complaint about this matter with the organisation, a complaints committee advised RCN Unit SZW to uphold the complaint. Rather than following this advice, however, the complaint was dismissed. According to RCN Unit SZW, this was because upholding the complaint would have had too great an impact upon the manager involved. The National Ombudsman finds that RCN Unit SZW acted in breach of its duty of impartiality by placing the manager’s interests before those of the complainant. The complaint is therefore upheld.
